An all-ages curfew at Virginia Beach’s Oceanfront has been suspended following a judge’s granting of a restraining order. This decision comes after five local businesses filed for the order, arguing the curfew was too vague and lacked evidence of imminent threat. The curfew, initially set for 9:30 p.m. Friday, has been canceled, although a separate curfew for unaccompanied minors from 7 p.m. to 5 a.m. remains in place.
During the hearing, attorney Kevin Martingale emphasized the negative impact on local businesses and questioned the necessity of the curfew. The judge noted that the city’s late issuance of the curfew called into question any existing danger.
A city spokesperson noted that the curfew was enacted following a recent shooting that injured eight people, aiming to ensure public safety. Despite the suspension, city leaders will review the decision for future actions.
Additionally, another legal challenge against the curfew was initiated by attorney Tim Anderson, who previously filed a nondisclosure order but decided to halt further action after the city agreed to dismiss charges against one plaintiff arrested under the curfew.
