Lamar Jackson is currently contesting a trademark request by Dale Earnhardt Jr. concerning the stylized No. 8 that Earnhardt has used on his JR Motorsports Race Team. Jackson, who also wears No. 8, previously challenged a trademark request from Troy Aikman for the same number. His legal team filed a notice opposing Earnhardt Jr.’s claims, arguing that they create confusion related to Jackson’s “ERA 8” brand.
In a social media update, Earnhardt Jr. announced that he has secured rights to eight classic designs he raced in the early 2000s while retiring other No. 8 variations contested by Jackson. Earnhardt Jr. has been associated with the No. 8 since the late 1990s, while trademark rights to the number lapsed after his stepmother, Teresa Earnhardt, failed to renew them.
The dispute centers on the potential for consumer confusion between the products associated with Jackson and Earnhardt Jr., particularly regarding a second stylized No. 8 that Jackson’s filing argues could mislead consumers.
