A Southern California health club, The Bay Club, is facing a lawsuit after an employee injured a 23-month-old child at its El Segundo day care facility. The complaint, filed by Matthew and Elena Kittle, alleges that on March 17, 2025, an employee threw their son, referred to as CK, six feet into the air, failing to catch him, resulting in a fall that caused a traumatic brain injury.
The Kittles claim that following the incident, The Bay Club downplayed its severity, misleading the parents about the child’s condition. Video evidence later revealed the fall’s true nature, contradicting the club’s claims that CK fell from only 1.5 feet. After the incident, CK was diagnosed with a concussion and other injuries, and continues to suffer from lasting symptoms like sensitivity to light, irritability, and hearing loss.
The lawsuit, filed against The Bay Clubs Co. LLC and Bay Club South Bay LLC, accuses the company of negligence, claiming it failed to properly hire and supervise staff. The suit also asserts that the daycare was operating illegally as California law requires licenses for child care centers, which the Bay Club allegedly does not possess.
The Kittles are pursuing a jury trial, along with punitive and civil penalties, following their claims of intentional concealment and mental distress due to the incident. The Bay Club has stated it cannot comment on ongoing litigation but emphasizes the importance of safety at their facilities.
