Bar Harbor Waterfront Hotel has been providing docking space for cruise ships for years, but Golden Anchor LC, which operates the West Street Harbor Resort Hotel, is currently contesting the town’s directive that requires cruise passengers to disembark on their property. This dispute arises amid new restrictions aimed at limiting cruise ship visits, which have increased significantly over the past few decades. In August, the town cited Golden Anchor for not obtaining a necessary boarding permit, part of new rules established last year to control cruise ship access.
Following the town’s appeal committee’s support of the violation, Golden Anchor has appealed to Hancock County Court, arguing that the requirements are unconstitutional and that the town’s enforcement powers are insufficient. They contend that these rules unfairly label cruise ship passengers as “nuisances” and claim the regulations do not apply equally to other tourist transportation methods.
While Golden Anchor contests the violation, Charles Sidman, a proponent of limiting cruise traffic, also filed an appeal against the town’s appeal committee’s decision. The cases have been transferred to the state business and consumer court. Previously, Bar Harbor residents voted on restrictions permitting only smaller cruise ships, and legal challenges continue regarding the town’s authority over maritime activities, with some arguing federal regulations take precedence.
