Getty Images is in a landmark copyright trial against London-based Stability AI, which started on Monday in the UK High Court. The trial could last up to three weeks and revolves around Getty’s claims that Stability’s AI image generator, Stable Diffusion, unlawfully uses its copyrighted photos on a massive scale.
Getty, arguing for the importance of licensing creative works, asserts that AI companies should obtain permission before using such images. Getty’s legal team emphasized that this case is about enforcing intellectual property rights, highlighting concerns over Stability’s negligence regarding copyright protections.
Stability AI counters that its practices are not illegal and that much of the training for its AI models occurs outside the UK on US servers. They argue that only a small fraction of generated images resemble Getty’s works and claim that Getty’s lawsuit poses a threat to the broader generative AI industry.
Experts predict that the court’s ruling may not significantly expand copyright exemptions for AI training but could influence future licensing negotiations. Stability AI has faced various challenges since its inception, including legal issues and competition from emerging startups.
