This order follows recent tensions in Minnesota concerning aggressive immigration roundups and incidents involving the shootings of two U.S. citizens by federal agents, which have caused public outrage. Despite prior orders from the Department of Homeland Security (DHS) and ICE to grant bail hearings for detained individuals, compliance remains lacking, leading to significant hardships for affected immigrants.
Schultz described the court’s patience as “running thin” and indicated that the situation warranted the unusual step of summoning the Acting Director in person, emphasizing that smaller measures to enforce compliance had failed. He noted that the ongoing failures in acknowledging court orders could extend detentions and deportations for individuals who had lived in the U.S. legally. If the detained individual in question were released before the hearing, the court would cancel Lyons’ appearance.
